Client’s Testimonial:
“Thanks for the update.”
On May 6th, 2016, and August 5th, 2016, we received another EB-1A (Alien of Extraordinary Ability) and EB-2 NIW (National Interest Waiver) approval for a Senior Scientist at a Startup Company in the Field of Organic Chemistry (Approval Notice).
General Field: Organic Chemistry
Position at the Time of Case Filing: Consultant as a QA Analyst & Senior Scientist
Country of Origin: India
Service Center: Nebraska Service Center (NSC)
State of Residence at the Time of Filing: Ohio
Approval Notice Date: May 6th, 2016 (EB-1A), 5th August, 2016 (NIW)
Processing Time: 6 months, 27 days (EB-1A), 8 months, 16 days (NIW)
Case Summary:
A consultant as a QA analyst & senior scientist at a startup company from India hired North America Immigration Law Group (WeGreened.com) to file two I-140 petitions on his behalf. He opted for EB-1A (Alien of Extraordinary Ability) and EB-2 NIW (National Interest Waiver) to increase his chances of getting a petition approval. Fortunately for him, both his petitions were approved (3 months apart). We are particularly pleased about his approved EB-1A as it allows him to adjust his status for permanent residence without waiting several years for his priority date to become current (which he would have had to do with his EB-2 NIW).
Organizing two petition packets:
Our law firm is well-armed with the experience to put together successful I-140 petitions. In this case, we had to build two strong cases for our client. Despite being very different, these cases had several similarities:
- We noted our client’s 5 published scientific articles, the 11 times he conducted peer reviews for 3 scientific journals, and the 72 citations gathered from his published work.
- Both petitions contained information on our client’s investigations. With research focused on designing and synthesizing organic molecules and executing multistep organic synthesis, our client has impacted the U.S. pharmaceutical sector, particularly in the development of novel anti-cancer medications.
- To bolster both petitions, we incorporated recommendation letters contributed by other experts in the field. We used the same set of letters for both petitions, and all six of the letters contained statements such as this: “It is evident that [Client] is a foremost figure in his field of study. I simply do not believe that he can be replaced by a scientist with lesser qualification. Furthermore, I assert that the scientific community and the greater United States would be worse off without his continued production.”
- Additional evidence of our client’s excellence in the field was also included such as a copy of his doctoral degree and his CV.
Becoming a permanent resident:
A little over 2 months after our client’s EB-1A petition was approved, we filed I-485 applications for him and his wife. It usually takes the USCIS between 5-10 months to process I-485 applications, and we join our client and his wife as they eagerly await favorable news from the USCIS.
