Success Stories: A Successful Tale of an Operations Research Specialist Who Secured NIW Approval in Just 5 Days, After Pursuing a Ph.D. in Industrial Engineering
Client’s Testimonial:
“Thank you so much for your help in getting my NIW case approved!”
On December 4th, 2023, we received another EB-2 NIW (National Interest Waiver) approval for an Operations Research Specialist in the Field of Industrial Engineering (Approval Notice).
General Field: Industrial Engineering
Position at the Time of Case Filing: Operations Research Specialist
Country of Origin: China
State of Residence at the Time of Filing: Georgia
Approval Notice Date: December 4th, 2023
Processing Time: 5 days (Premium Processing Requested)
Case Summary:
Our client, an operations research specialist, wanted to bypass the necessity for a Request for Evidence (RFE) by submitting an I-140 NIW petition, and he hired the North America Immigration Law Group for that. After considering his exceptional research background, we accepted his case because of our established legal practice and the more than 32K employment-based visa applications we had filed successfully. The goal was to construct a national interest waiver petition packet that included all pertinent facts.
To be eligible for the NIW category, the petitioner must show that he adheres to the Matter of Dhanasar and has an advanced degree. This is a three-part test that entails presenting a project for the work in the US and explaining why it is important for the country, outlining why he is in a good position to develop the project, and explaining why, overall, the US should forego the need for a job offer.
Thus, we observed that our client possessed a Ph.D. in industrial engineering and had published 6 peer-reviewed journal articles and 3 conference papers, in no fewer than three highly regarded journals. These publications have received a total of 242 citations, indicating that they are well-known and dependable in the industrial engineering community.
He has also completed at least 10 peer reviews thus far. Given that only the most renowned professionals in the area are invited to assess the work of their peers, particularly in significant venues, it is apparent that our client is considered very competent in the field of industrial engineering.
Furthermore, we discussed his proposed endeavor, as an expert in industrial engineering, to develop cutting-edge complex system optimization models and algorithms to enhance the operational efficiency and equity of transportation systems, energy systems, emergency management, and other large-scale systems. The research supporting this endeavor is highly significant because it advances the optimization of energy systems, which in turn helps reduce greenhouse gas emissions through integrating electric vehicles and energy sharing.
In fact, the U.S. Department of Energy and the National Science Foundation have funded his research because of its evident national significance. This funding is only available for research that advances the interests of the country, such as initiatives to “promote the progress of science; to advance the national health, prosperity, and welfare; to secure the national defense” and “to ensure America’s security and prosperity by addressing its energy, environmental, and nuclear challenges through transformative science and technology solutions.”
With our client’s proven track record of successful research in a field that significantly advances U.S. interests, we were able to successfully demonstrate once again how valuable his contributions are and how he would benefit the United States as a whole. Just before the year concluded, NIW approval was granted to him. He was ecstatic to learn that our team’s efforts and the many hours we had put in had paid off. We congratulate him on this remarkable accomplishment.
